1. Acceptance of Terms

Welcome to Mishal Jethva Arts. By using this website, submitting a commission inquiry, creating an account, or placing any order, you agree to these Terms & Conditions. All artworks are uniquely hand-painted by Mishal Jethva.

2. Products: Originals vs. Commissions

Ready-Made Artworks: These are pre-painted original artworks or canvas prints. They are subject to availability and dispatched shortly after purchase.

Custom Commissions: These are bespoke artworks painted from scratch based on customer requirements and reference photos. Commissions require a specific timeline (typically 3-4 weeks) for painting, drying, and varnishing.

3. Commission Payments and Revisions

Custom commissions require a 40% advance deposit to secure your spot and begin the painting process. The remaining 60% balance is due only after the painting is fully finished and approved.

You will receive a digital preview (photograph) of the final artwork via email before dispatch. Because your satisfaction is my highest priority, I offer unlimited revisions on custom commissions. Shipping processes will only commence once you are 100% satisfied, approve the preview, and process the final balance.

4. Pricing, Currency, and Taxes

Our internal base pricing is maintained in Indian Rupees (INR). Displayed exchange-based prices in other currencies are estimates until checkout is finalized.

Customers are strictly responsible for any local import duties, customs fees, brokerage charges, VAT, or local taxes charged by their destination country upon arrival.

5. Cancellations and Refunds

Commissioned Artworks: Because these are uniquely personalized and hand-painted for you, once the painting process has started, orders generally cannot be cancelled for a full refund. Any cancellation request must be made within 24 hours of placing the order.

Ready-Made Artworks: Customers may cancel an order for ready-made pieces only while its order status remains placed (prior to dispatch).

6. Intellectual Property & Copyright

All artwork designs, images, videos, time-lapses, and website content remain the sole intellectual property of Mishal Jethva. Purchasing a physical original painting or commission does not transfer copyright or commercial reproduction rights.

You may not scan, mint as NFTs, mass-reproduce, or commercially exploit any artwork purchased here without prior written licensing agreements.

7. Color and Display Variations

Every effort is made to accurately represent artworks through high-resolution photography. However, due to natural lighting, texture of the canvas/paper, and variations in digital screen calibrations, slight color differences may occur. This is a natural aspect of purchasing physical art.

8. Governing Law

These Terms are governed by the laws of India. Any dispute relating to the website, commission contracts, or studio transactions will be subject exclusively to the competent courts having jurisdiction in India.
